Abstract

Wim Decockcollects contributions by internationally renowned experts in law, history and religion on the impact of the Reformations on law, jurisprudence and moral theology. The overall impression conveyed by the essays is that on the level of substantive doctrine (the legal teachings) there seems to be more continuity between Protestant and Catholic, or, for that matter, between medieval and early modern jurisprudence and theology than usually expected. As it is illustrated with regards to topics ranging from just war doctrine over business ethics to marriage law, at the very least there appears to have been an on-going conversation between jurists and theologians across the confessional divide. This does not prevent some contributions from highlighting that on the institutional level, for instance in university politics, radical tensions between Reformers and Counter-Reformers played a paramount role. This book also offers approaches to the relationship between Church(es) and State(s) in the early modern period and to the practical as well as doctrinal use of natural law in both Protestant and Catholic lands.

Abstract

In the late fourth century, in the absence of formal church councils, bishops from all over the Western Empire wrote to the Pope asking for advice on issues including celibacy, marriage law, penance and heresy, with papal responses to these questions often being incorportated into private collections of canon law. Most papal documents were therefore responses to questions from bishops, and not initiated from Rome. Bringing together these key texts, this volume of accessible translations and critical transcriptions of papal letters is arranged thematically to offer a new understanding of attitudes towards these fundamental issues within canon law. Papal Jurisprudence, c.400 reveals what bishops were asking, and why the replies mattered. It is offered as a companion to the forthcoming volume Papal Jurisprudence: Social Origins and Medieval Reception of Canon Law, 385-1234.

Abstract

Il est assez fréquent, en France, de trouver un orgue à tuyaux dans une église. La sonorité de cet instrument est volontiers associée à ces lieux de culte. Cependant, moins connue est son admission très progressive dans la liturgie catholique latine. Ou encore, qu'un ensemble de normes juridiques a été élaboré pour encadrer son usage. Cet ouvrage se propose d'aborder le droit canonique lié à l'orgue et à la fonction d'organiste dans la liturgie. En parcourant l'histoire de cet instrument, ainsi que la théologie qui s'est développée autour de lui, le droit ecclésial montre que l'influence de la musique dans le culte a toujours été un sujet d'attention. Par ailleurs, il est devenu indispensable aujourd'hui d'intégrer le droit civil français, notamment pour la gestion matérielle des instruments ou la condition des musiciens. La connaissance du droit peut-elle guider la pratique musicale dans les églises, tant pour la liturgie que pour les concerts ? Peut-il aider à réguler d'éventuels conflits entre pasteurs, musiciens, et instances civiles ? C'est ce que l'auteur propose de découvrir, dans une étude où se côtoient deux domaines pourtant très différents : l'art et le droit.
